Understanding the Regulatory Framework
Under the Code of Maryland Regulations (COMAR) 13B.02.02.06, an “In-State institution” refers to a degree-granting institution whose primary campus is in Maryland and whose authority to grant degrees is conferred by Maryland. The approval process involves two stages, which must be completed before the Secretary of Higher Education grants institutional approval to operate.
Steps to Obtain State Approval
Stage One Application
- Initial Steps:
- Review State Requirements: Familiarize yourself with COMAR 13B.02.02.06 and ensure your institution meets the basic eligibility criteria for licensure.
- Contact MHEC: Reach out to the Maryland Higher Education Commission to request the Stage One application form and guidelines.
- Prepare Documentation:
- Compelling Need and Demand: Demonstrate a compelling regional or statewide need and demand for the proposed programs.
- Financial Resources: Provide evidence of adequate financial resources to establish and maintain the institution.
- Additional Information: Include any additional information the Secretary of Higher Education requires.
- Submission:
- Submit the completed Stage One application form, required documentation, and a non-refundable application fee ($7,500 for up to two-degree programs, plus $850 for each additional program).
- The application will be distributed to all higher educational institutions in Maryland for a 30-day comment period.
- Review and Decision:
- The Secretary will consider all comments and objections received and may request additional information from the applicant.
- The final decision on the Stage One proposal will be made public at a regularly scheduled Maryland Higher Education Commission meeting.
- If approved, the institution can proceed to complete and submit the Stage Two application.
