Understanding the Regulatory Framework

Private post-secondary institutions that provide educational services in New Mexico must comply with the New Mexico Post-Secondary Educational Institution Act or the Interstate Distance Education Act. These statutes ensure institutions meet educational standards and protect student interests.

Who approves a new college or trade school in New Mexico?

In New Mexico, private colleges and career schools get state authorization from the New Mexico Higher Education Department (NMHED): a college that holds, or is seeking, what the state's rules call regional accreditation registers, while career schools and other colleges apply for a license.

AEC doesn't issue Florida licenses and can't promise one. The Commission for Independent Education decides.

AEC's founder, Dr. Ramin Golbaghi, went through these approvals as a school owner. He founded and led a private postsecondary school, he personally obtained state approval to operate, ACCSC institutional accreditation, Title IV certification, VA education benefits approval, WIOA/I-TRAIN workforce eligibility and SEVP certification.

Steps to Obtain State Approval

  1. Determine the Appropriate Type of Authorization
  • Certificate of State Authorization (Registrations):
For institutions holding what New Mexico’s rules call regional accreditation, with a physical presence in New Mexico.
  • Certificate of State Authorization (License):

For career schools and colleges without that accreditation, with a physical presence in New Mexico.

  • Certificate of State Authorization (Distance Education):

This is for institutions not NC-SARA approved but offer online programs to New Mexico students.

  • Certificate of State Authorization (Out-of-State Proprietary Schools):

For out-of-state proprietary schools soliciting students in New Mexico.

  1. Application Process
  • Initial Application Submission:
  • Institutions must complete the appropriate application form available on the NMHED website.
  • Submission Requirements:
  • Include detailed information such as self-evaluation processes, accreditation status, degree standards, information provided to students, admissions procedures, tuition refund policies, student record maintenance, financial stability, and student complaint procedures.
  • Financial Statement:
  • A CPA-prepared financial statement (audited or reviewed) is mandatory for the application.
  1. Review and Evaluation
    • Staff Review:
  • NMHED staff will process applications in the order received. Early submission is encouraged to address any deficiencies promptly.
  1. Annual Reporting and Renewal
    • Annual Reports:
  • Institutions must submit annual reports detailing student data, institutional information, and actions taken by accrediting bodies.
    • Renewal Application:
  • State Authorization must be renewed annually. Institutions must update their information and ensure continued compliance with state regulations.
    • Substantial Changes:
  • Any substantial changes from the State Authorization application must be reported to NMHED.

Accreditation Requirements

  1. Degree-Granting Institutions:
    • Must be accredited by an agency recognized by the U.S. Department of Education. New degree-granting institutions must obtain accreditation within three years of submitting the initial application, including a written accreditation plan.
  1. Distance Education:
    • Institutions offering distance education must be accredited at the time of application.
