Steps to Obtain State Approval

Initial Consultation and Preparation

Initial Consultation:

  • Engage in an initial consultation with the Office of the Postsecondary Commissioner (RI OPC) staff to understand the regulatory requirements and approval process.
  • Determine the type of approval needed: initial institution/program approval, approval for additional programs, or conditional approval.

Accreditation Requirements:

  • Begin discussions with the New England Commission of Higher Education (NECHE) if you are a degree-granting institution.

Submit a Complete Proposal

Proposal Components:

  • A letter from the institution’s chief executive officer requesting authorization to operate in Rhode Island.
  • An unbound original and four copies of a complete proposal developed according to the Council’s specified format.

Supporting Documentation:

  • Provide detailed information about the institution’s mission, programs, governance structure, faculty qualifications, student services, financial stability, and facilities.
  • Include evidence of discussions with NECHE and progress toward accreditation.

Who approves a new college or trade school in Rhode Island?

In Rhode Island, private colleges and career schools need approval from the Rhode Island Council on Postsecondary Education, whose staff at the Office of the Postsecondary Commissioner (RI OPC) review every application under two sets of rules: one for degree-granting colleges and post-associate certificate providers, one for trade schools.
In Rhode Island, a for-profit school can't grant degrees without a state law passed for it.

AEC's founder, Dr. Ramin Golbaghi, went through these approvals as a school owner. He founded and led a private postsecondary school, he personally obtained state approval to operate, ACCSC institutional accreditation, Title IV certification, VA education benefits approval, WIOA/I-TRAIN workforce eligibility and SEVP certification.

Review and Evaluation by RIOHE Staff

Staff Review:

  • RI OPC staff will review the submitted proposal and accrediting agencies.
  • Staff will visit the institution’s proposed site(s) of operation and communicate with institutional representatives during the review process.

Compliance with Criteria:

  • Ensure the proposal meets all review criteria, including program definitions, student admission standards, faculty qualifications, instructional resources, and fiscal responsibilities.

Council Approval Process

Recommendation for Action:

After RI OPC staff review, the Commissioner sends a recommendation, with a Council committee’s endorsement, to the Council, which approves or denies.

Approval Types:

  • Initial Approval: Granted for five years and is not renewable. Institutions must seek full or conditional approval before the initial approval period expires.
  • Full Approval: Granted for an indefinite period for non-profit institutions, subject to periodic evaluations.
  • Conditional Approval: Granted under certain circumstances and must be renewed annually.

Post-Approval Requirements

Annual Reviews:

  • Institutions with initial or conditional approval must undergo annual reviews to ensure compliance with the original proposal and regulatory standards.

Documentation Maintenance:

  • Maintain comprehensive records, including student records, financial statements, and faculty qualifications, according to AACRAO guidelines and state regulations. These records demonstrate compliance with regulations and provide a basis for continuous improvement and future planning. Renewal and Substantive Changes

Renewal Applications:

  • Institutions must apply for approval renewal six months before the initial or conditional approval period expires.

Substantive Changes:

  • Please notify the Council of any substantive changes, such as changes in legal status, program offerings, course delivery modes, or geographical setting.
